Abiental is a technology platform focused on the environment, offering, among other features:

• Visual identification of species (plants, animals, fungi).
• Preliminary detection of plant diseases.
• Astronomical data (moon phases) and weather information.
• Virtual assistant integrated with Artificial Intelligence.

PIESKE ONE reserves the right to add, remove or modify features at any time without prior notice.

2. Registration and Account Security

To access advanced features, the User must create an account:

• Accuracy: You agree to provide true, accurate, current and complete information.
• Security: Password protection is your sole responsibility. We are not responsible for unauthorized access resulting from user negligence.
• Minors: Use by children under 13 years of age must be supervised by parents or guardians.

3. Artificial Intelligence Limitations

You acknowledge and agree that:

1. The identifications provided by the app are probability-based suggestions and do not replace analysis by a professional (biologist, botanist or agronomist).
2. Never ingest plants, fungi or fruits based solely on the application's identification. There is a risk of death or serious poisoning in case of error.
3. PIESKE ONE is not responsible for damages resulting from decisions made based on information from the application.

4. User Obligations

By using Abiental, you agree NOT to:

• Use the application for illegal purposes or to promote criminal activities.
• Attempt to reverse engineer, decompile or copy the application's source code.
• Upload offensive, pornographic photos or content that violates third-party rights.
• Perform "scraping" or massive data collection from the platform.

5. Intellectual Property and Content

PIESKE ONE Rights

All design, logos, code, graphics, software and the "Abiental" brand are exclusive property of PIESKE ONE LTDA and are protected by copyright and industrial property laws.

User Content

When uploading photos for identification in the application:

• You retain copyright on your photos.
• However, you grant PIESKE ONE a worldwide, non-exclusive and royalty-free license to use, store and process these images for the purpose of providing the service and training/improving Artificial Intelligence models, as detailed in the Privacy Policy.

6. Disclaimer of Warranties and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS".

PIESKE ONE does not guarantee that the service will be uninterrupted, error-free or completely secure. Under no circumstances shall PIESKE ONE be liable for indirect, incidental, special or consequential damages (including, without limitation, damages for loss of data or profits) arising from the use or inability to use the application.

7. Data Privacy

The processing of your personal data is governed by our Privacy Policy. By accepting these Terms, you acknowledge that you have read and agree to how we collect and use your data.

8. Changes and Cancellation

We may change these Terms at any time. If the changes are significant, we will notify you through the application or email. Continued use after changes constitutes acceptance of the new terms.

We may also suspend or terminate your account immediately if you violate these Terms, without right to compensation.

9. Jurisdiction and Contact

These terms are governed by the laws of the Federative Republic of Brazil. The Court of the District of Timbó - SC is elected to settle any disputes, with waiver of any other.
